WIN TICKETS TO SPLENDOUR - TERMS & CONDITIONS

 TERMS & CONDITIONS OF ENTRY

  1. TOM Organic Pty Ltd (ACN 005 054 893) of 105 Wellington St, St Kilda Victoria is the Promoter (Promoter).
  2. Instructions on how to enter and the prize form part of the conditions of entry (T+Cs). Participation in this Competition constitutes acceptance of the T+Cs.
  3. The Competition will run from 12.01 am on Wednesday May 15 (AEST) to 11.59 pm on Wednesday May 29 (AEST). (Promotion Period)
  4. Entry during the Promotion Period is open only to Australian residents in all Australian States and Territories excluding employees and their immediate families of the Promoter and its related companies (Eligible Participant).
  5. To enter the Competition, an Eligible Participant must:
    • Purchase any TOM Organic product during the Promotion Period
    • Retain proof of purchase (receipt) to be provider to the promoter in order to claim prize
    • Enter via responding in writing to all questions on the competition form (Competition Form); and
    • Submit the Competition Form to the Promoter via promoters website within the Promotion Period.
  6. Any entry submitted outside of the Promotion Period will not be accepted. The Promoter does not accept any responsibility for late, lost or misdirected entries.
  7. The Competition will be judged by the Promoter according to its assessment of the best answer to the required questions contained in each Eligible Participant’s Completed Competition Form (Judging Criteria).
  8. Each purchase receipt will only be eligible for one entry into the Competition
  9. Judging of the of the Competition will take place between Wednesday 29 May 2019 to Friday 31 May 2019 at 105 Wellington St, St Kilda, Victoria (Judging Period).
  10. The Winner of the competition will be contacted by direct message or email within 5 business days of the conclusion of the Judging Period and may be announced via the Promoter’s social media platforms.
  11. The judge’s decision on selecting the Winner is final. No correspondence will be entered into regarding the judge’s decision.
  12. The prize for the competition is:
    • 4 x VIP 3 day passes to Splendour in the Grass festival, held on Friday 19 July to Sunday 21 July 2019 at North Byron Parklands, NSW,
    • 4 x camping tickets to Splendour in the Grass festival
    • 4 x TOM Organic festival survival kits
    • 4 x 6 month subscriptions of TOM Organic product
  13. The total prize is valued at approximately $4,000
  14. The Promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date.
  15. If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value.
  16. The prize is non-negotiable, non-transferable, non-exchangeable and non-refundable. No cash or credit alternatives will be given in exchange for the whole, or any part of the prize.
  17. The main prize of 4 VIP tickets to Splendour in the Grass and 4 Camping tickets to Splendour in the grass will be supplied to the winner electronically, or via post to the winner’s specified address. The remainder of the prize will be available for collection at the TOM Organic activation at Splendour in the Grass. Winner will require photo ID to claim prizes.
  18. The Promoter reserves the right to request the Winner to provide proof of identity, proof of residency and/or proof of entry validity in order to claim the prize. The suitability of proof identification, residency and entry, for the purpose of verification, is at the reasonable discretion of the Promoter. If the Promoter makes such a request and the Winner fails to provide reasonably suitable proof of identification, residency and/or entry, the Winner will forfeit the prize in whole.
  19. Every attempt will be made to contact the Winner, however, should the prize remain unclaimed after Monday June 3 (5 days from the date the Winner is announced), the prize will be forfeited. In the event that the Winner is not able to be contacted, the Promoter will allocate the prize to a secondary winner. If the Promoter selects a secondary winner, the secondary winner will be deemed to be the Winner for the purposes of these T+Cs.
  20. Unless expressly stated, all other expenses become the responsibility of the Winner.
  21. The Winner expressly agrees to the use of their name and address for competition purposes, without compensation.
  22. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the competition. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
  23. To the extent permitted by law, the Promoter, its employees and agents shall not be liable for any claim, loss, damage, injury, cost or expense whatsoever suffered, sustained or incurred as a result of, or arising out of, or in any way connected with this Competition and its prizes.
  24. Each entrant’s personal information will be collected to enable the Promoter to administer the Competition. By entering this Competition, each entrant agrees that the Promoter may use and disclose entrants’ personal information for future promotional, social media, marketing or publicity purposes including but not limited to website content.
  25. Each entrant expressly consents to its personal information being disclosed to the Promoter’s partners in the Competition for the purposes of issuing and delivering the prize.
  26. Any entrant, who fails to provide all requested Personal Information, may be determined by the Promoter, at its sole discretion to be ineligible to win the prize. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  27. All entries become the property of the Promoter. As such, the Promoter is the owner of all copyright and other intellectual property in entries to the Competition including the winning entry.
  28. If for any reason the competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter, which corrupt or affect the administration security, fairness or integrity or proper conduct of this competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process or to cancel, terminate, modify or suspend the competition.
  29. By entering and participating in the Competition, each entrant agrees to hold harmless, defend and indemnify Facebook and / or Instagram from and against any and all claims, demands, liability, damages or causes of action (however named or described), losses, costs or expenses, with respect to or arising out of the Competition.
