Pitch for Purpose 2020

TERMS AND CONDITIONS OF ENTRY

  1. TOM Organic Pty Ltd (ACN 005 054 893) of 105 Wellington St, St Kilda Victoria is the Promoter (Promoter).
  2. Instructions on how to enter and the prize form part of the conditions of entry (T+Cs). Participation in this Competition constitutes acceptance of the T+Cs.
  3. The Competition will be run over two rounds as follows:
    • The first Competition period opens at 9:01am on Monday 03 February 2020 (AEST) and closes at 11:59pm on Sunday 23 February 2020 (AEST) (First Promotion Period).
    • The second round of the Competition, for those entrants chosen as finalists from the First Promotion Period, opens at 12:01am on Tuesday 3 March 2020 (AEST) and closes at 11:59pm on Tuesday 17 June 2020 (AEST) (Finalist Promotion Period).
  4. Entry during the First Promotion Period is open only to Australian residents in all Australian States and Territories excluding employees and their immediate families of the Promoter and its related companies (Eligible Participant).
  5. To enter the Competition, an Eligible Participant must:
    • respond to all questions within the competition form, including uploading a short video explaining what their business is. (First Competition Form); and
    • Submit the First Competition Form to the Promoter via promoters website within the First Promotion Period.
  6. Any entry submitted outside of the First Promotion Period will not be accepted. The Promoter does not accept any responsibility for late, lost or misdirected entries.
  7. The first round of the Competition will be judged by the Promoter according to its assessment of the best answer to the required questions contained in each Eligible Participant’s Completed Competition Form (First Judging Criteria).
  8. The judging of the first round of the Competition will take place between Monday 24 February 2020 to Monday 2 March 2020 at 105 Wellington St, St Kilda, Victoria (First Judging Period).
  9. During the First Judging Period, the Promoter will select five finalists based on the First Judging Criteria (Eligible Finalist).
  10. Each Eligible Finalist will be contacted by direct message or email within 5 business days of the conclusion of the First Judging Period and may be announced via the Promoter’s social media platforms.
  11. The Promoter reserves the right to request each Eligible Finalist to provide proof of identity and/or proof of residency. The suitability of proof identification and/or residency for the purpose of verification, is at the reasonable discretion of the Promoter. If the Promoter makes such a request and the Eligible Finalist fails to provide reasonably suitable proof of identification and/or residency, the Eligible Finalist will forfeit the right to further participate in the Competition and/or win the prize in whole.
  12. During the Finalist Promotion Period, each Eligible Finalist must:
    • Allow the short video biography they provided via the entry form to be shared by the Promoter across social media platforms;
    • respond in writing or over the phone to all questions within the finalist competition form (Finalist Competition Form);
    • Submit the Finalist Competition Form to the Promoter via email within the Finalist Promotion Period.
  13. Any entry by an Eligible Finalist submitted outside of the Finalist Promotion Period will not be accepted. The Promoter does not accept any responsibility for late, lost or misdirected entries.
  14. The second round of the Competition will be judged by the Promoter according to its assessment of the best answer to the required questions contained in each Eligible Finalist’s Finalist Competition Form. (Finalist Judging Criteria).
  15. The judging of the second round of the Competition will take place between Tuesday 3 March 2020 to Tuesday 17 March 2020 at 105 Wellington St, St Kilda, Victoria (Finalist Judging Period).
  16. The winner of the Competition will be selected by the Promoter at the conclusion of the Finalist Judging Period based on the best entry against the Finalist Judging Criteria (the Winner).
  17. The judge’s decision on selecting the Winner is final. No correspondence will be entered into regarding the judge’s decision.
  18. The Winner of the Competition will be contacted by direct message, phone or email within 5 business days of the conclusion of the Finalist Judging Period and may be announced via the Promoter’s social media platforms.
  19. The prize for the competition is:
    • a $10,000 grant provided by the Promoter to be used as agreed on between the Sponsor and the Winner during the Judging Period;
    • 6 x business mentoring sessions with the Promoter to be organise by the entrant
  20. The total prize is valued at approximately $13,000.
  21. The Promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date.
  22. If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value.
  23. Subject to clauses 24 and 25, the prize is non-negotiable, non-transferable, non-exchangeable and non-refundable. No cash or credit alternatives will be given in exchange for the whole, or any part of the prize.
  24. The Promoter reserves the right to request the Winner to provide proof of identity, proof of residency and/or proof of entry validity in order to claim the prize. The suitability of proof identification, residency and entry, for the purpose of verification, is at the reasonable discretion of the Promoter. If the Promoter makes such a request and the Winner fails to provide reasonably suitable proof of identification, residency and/or entry, the Winner will forfeit the prize in whole.
  25. The Winner’s acceptance of the prize is conditional on the Winner using the funds towards an agreed activity for their business between the Winner and Sponsor during the Judging Period. The Sponsor will not release the funds until satisfied that the Winner will use them as agreed.
  26. Every attempt will be made to contact the Winner, however, should the prize remain unclaimed after Tuesday March 24 (5 days from the date the Finalist is announced), the prize will be forfeited. In the event that the Winner is not able to be contacted, the Promoter will allocate the prize to a secondary winner from the remaining four Eligible Finalists.  If the Promoter selects a secondary winner, the secondary winner will be deemed to be the Winner for the purposes of these T+Cs.
  27. Unless expressly stated, all other expenses become the responsibility of the Winner.
  28. The Winner expressly agrees to the use of their name and address for competition purposes, without compensation.
  29. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the competition. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
  30. To the extent permitted by law, the Promoter, its employees and agents shall not be liable for any claim, loss, damage, injury, cost or expense whatsoever suffered, sustained or incurred as a result of, or arising out of, or in any way connected with this Competition and its prizes.
  31. Each entrant’s personal information will be collected to enable the Promoter to administer the Competition. By entering this Competition, each entrant agrees that the Promoter may use and disclose entrants’ personal information for future promotional, social media, marketing or publicity purposes including but not limited to website content.
  32. Each entrant expressly consents to its personal information being disclosed to the Promoter’s partners in the Competition for the purposes of issuing and delivering the prize.
  33. Any entrant, who fails to provide all requested Personal Information, may be determined by the Promoter, at its sole discretion to be ineligible to win the prize. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  34. All answers to entry questions become the property of the Promoter, including the specific video to be uploaded in answer to the question ‘First up, give us your elevator pitch’. Any supporting material relating to the entrants business concepts, ideas and marketing plans will remain the property of the entrant and not shared externally to the TOM Organic business unless agreed upon in writing with the entrant.
  35. If for any reason the competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter, which corrupt or affect the administration security, fairness or integrity or proper conduct of this competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process or to cancel, terminate, modify or suspend the competition.
  36. By entering and participating in the Competition, each entrant agrees to hold harmless, defend and indemnify Facebook and / or Instagram from and against any and all claims, demands, liability, damages or causes of action (however named or described), losses, costs or expenses, with respect to or arising out of the Competition.
