Terms and Conditions of Entry

  1. The Promoter is TOM Organic Pty Ltd (ACN 005 054 893) of 105 Wellington St, St Kilda VIC 3182.
  2. Instructions on how to enter and the prize form part of the conditions of entry (T+Cs). Participation in this Competition constitutes acceptance of the T+Cs.
  3. The Competition opens at 12:01am on Friday 26 October 2018 (AEDT) and closes at 11:59pm on Monday 7 January 2019 (AEDT) (Promotion Period).
  4. Entry is open only to Australian residents in all Australian States and Territories excluding employees and their immediate families of the Promoter and its related companies (Eligible Participant).
  5. To enter the Competition, an Eligible Participant must respond to all questions within the competition form, including the competition question from which your entry will be judged.
  6. Any entry submitted outside of the Promotion Period will not be accepted. The Promoter does not accept any responsibility for late, lost or misdirected entries.
  7. The Competition will be judged by the Promoter according to best answer to the question TELL US IN 25 WORDS OR LESS WHAT YOU LOOK FOR MOST IN A NAPPY BRAND? (Judging Criteria).
  8. The judging of the competition will take place on Tuesday 8 January 2019 at 105 Wellington St, St Kilda, 3182, VIC (Judging Date).
  9. The winner of the Competition will be selected by the Promoter on the Judging Date based on the best entry against the Judging Criteria (the Winner).
  10. The judge’s decision on selecting the Winner is final. No correspondence will be entered into regarding the judge’s decision.
  11. The Winner of the Competition will be contacted by direct message or email within 5 business days of the Judging Date and may be announced via the Promoter’s social media platforms.
  12. The prize for the Competition is a 12 month supply of tooshies by TOM nappies and wipes via subscription, valued at approximately $1,188.00.
  13. The Promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date.
  14. If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value.
  15. Subject to clause 14, the prize is non-negotiable, non-transferable, non-exchangeable and non-refundable. No cash or credit alternatives will be given in exchange for the whole, or any part of the prize.
  16. The Promoter reserves the right to request the Winner to provide proof of identity, proof of residency and/or proof of entry validity in order to claim the prize. The suitability of proof identification, residency and entry, for the purpose of verification, is at the reasonable discretion of the Promoter. If the Promoter makes such a request and the Winner fails to provide reasonably suitable proof of identification, residency and/or entry, the Winner will forfeit the prize in whole.
  17. Every attempt will be made to contact the Winner, however, should the prize remain unclaimed after 8 April 2019 (three months from the date the Competition Winner is announced), the prize will be forfeited and will not be otherwise allocated.
  18. Unless expressly stated, all other expenses become the responsibility of the Winner.
  19. The Winner expressly agrees to the use of their name and address for competition purposes, without compensation.
  20. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the competition. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
  21. The Promoter will take all reasonable steps to deliver the Prize to the Winner, at the Promoters expense, within 30 days from the Judging Date. The prize will be sent to the delivery address provided to the Promoter by the Winner.
  22. The Promoter, their associated agencies and companies associated with this Competition take no responsibility for any delay in delivery, damage to or loss in transit of the prize.
  23. To the extent permitted by law, the Promoter, its employees and agents shall not be liable for any claim, loss, damage, injury, cost or expense whatsoever suffered, sustained or incurred as a result of, or arising out of, or in any way connected with this Competition and its prizes.
  24. Each entrant’s personal information will be collected to enable the Promoter to administer the Competition. By entering this Competition, each entrant agrees that the Promoter may use and disclose entrants’ personal information for future promotional, social media, marketing or publicity purposes including but not limited to website content.
  25. Each entrant expressly consents to its personal information being disclosed to the Promoter’s partners in the Competition for the purposes of issuing and delivering the prize.
  26. Any entrant, who fails to provide all requested Personal Information, may be determined by the Promoter, at its sole discretion to be ineligible to win the prize. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  27. All entries become the property of the Promoter. As such, the Promoter is the owner of all copyright and other intellectual property in entries to the Competition including the winning entry.
  28. If for any reason the competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter, which corrupt or affect the administration security, fairness or integrity or proper conduct of this competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process or to cancel, terminate, modify or suspend the competition.
  29. By entering and participating in the Competition, each entrant agrees to hold harmless, defend and indemnify Facebook and / or Instagram from and against any and all claims, demands, liability, damages or causes of action (however named or described), losses, costs or expenses, with respect to or arising out of the Competition.
  30. This promotion is in no way sponsored, endorsed or administered by, or associated with Facebook and / or Instagram.
